Stout had before him an originating summons to determine the legality of the marriage of John MacPherson, of Matata, who was believed to be married to a Maori woman named Mariana Teoha, and if the union were legal the children were entitled to share in the estate of their uncle, Malcolm MacPherson, of England. John MacPherson died at Matata in 1887, leaving several children. The Chief Justice said there was no evidence of the authorisation of the marriage by any registrar or any certificate by any registrar or clergyman. It was agreed that MacPherson lived as man and wife, and were generally regarded as such. Some feast or celebration was held to commemorate the marriage, and Mariana said it took place in the Roman Catholic Chapel at Matata with Father Mac Donald, now dead, officiating. MacPherson, however, was a Presbyterian, and no register could be adduced. Several witnesses said they always looked on the pair as married. It was a common practice for white men to contract what was called a Maori marriage with native women, but it had never been recognised by law as valid. Moreover, at the time, Mariana was under age, and no consent was given by her guardian, properly appointed. She was the daughter of Andrew Read, a native of Virginia, who removed to Kentucky after his daughter was born. He was of Scotch-Irish extraction. His father, Frank Read, was a Revolutionary soldier, and he, himself, was a soldier in the War of 1812-15. Her mother's family, of French extraction named Leftwich were early settlers of Virginia. The result of this marriage was six children, viz: Belle, Kate, Elizabeth, Anna, Howard, and Ida. Kate is married to George Craig, and lives in Johnson county, Ind.; the others are at home, except Belle, who is at Indianapolis, Ind. Mr. Woods owns 200 acres of good land, well improved. WALDO PETTENGILL, of Rumford Falls, the Vice-President and Manager of the Portland & Rumford Falls Railroad, has been largely instrumental in developing Rumford. He was born at Livermore Falls, Me., December 1, 1844, son of Oliver and Huldah (Baker) Pettengill, both natives of this state. Oliver Pettengill, who was born in the town of Fayette, Kennebec County, spent his early life there and in East Livermore, chiefly occupied in farming. In 1866 he purchased a large farm in Rumford, about six miles from the present village, and settled there permanently. In addition to being a farmer he was also a mill man, was very successful in a financial way, and at his death, which happened in his sixty-sixth year, he left a large estate. I was 12 years old on the train May 29 when my father decided to go there for his health, he had asthma so bad, thinnking the mild climate might help. I had a half sister married living there, her name was Mrs. Henry Harris, her name was Margaret Jane. I had a step mother, and they had little baby girl 2 yrs old at the time my father died in Jan. He only lived that long from May until Jan 21st 1898, he left insurance, his widow buried him in a little church grave yrd near the fense, a tomb stone I remember well. He was 52 yrs old at that time He was working in a lumber camp to get lumber to build a house on some ground he had bought, but in trying to avoid being crushed, after some men above him on the mountainside yelled at him, he tried to get up on a stump in front of him but didn't make it in time. He was crushed so badly. He died from internal bleeding the Dr. said. It was a christian church in the country at a place called Harmony His widow came back to Kansas with her little girl they called Bethel. I have no pictures of my folks and I know of none. I can't remember of any obituary. The step mother is dead. She afterward married a man so they told me by the name of Hill. I never saw her. It was in 1900. I wasn't 17 yet when I came back to Kansas because I had a sister a Mrs. Martin Burch, that wanted one of her 2 sisters to come live with her. I had a sister Emma 3 yrs younger than I. She stayed there with the half sister. I came back. We had an guardian appointed over us because he left $800 a piece for us girls. So I was married Feb 14th a yr later to Walden Rossiter, 2 children Merlin the boy and Acelia Roberta. Merlin is dead. Daughter lives in Kans City. Rufus Procter was my guardian's name. He is dead.
